1. Overview

India's labour law framework was consolidated into four Labour Codes, all of which became effective across India from 21 November 2025. These Codes replace dozens of earlier central labour statutes with a modernized, consolidated framework.

The Precision Payroll calculators operate in the context of this post-Code framework for current payroll periods. Historical records predating the Codes' commencement were governed by the earlier statutes.

2. The Four Labour Codes

Code on Wages, 2019 (Act No. 29 of 2019)

Consolidates the Payment of Wages Act, 1936; Minimum Wages Act, 1948; Payment of Bonus Act, 1965; and Equal Remuneration Act, 1976. Governs wage definitions, minimum wages, payment of wages, deductions and bonus.

Industrial Relations Code, 2020 (Act No. 35 of 2020)

Consolidates the Trade Unions Act, 1926; Industrial Employment (Standing Orders) Act, 1946; and Industrial Disputes Act, 1947. Governs industrial relations, dispute resolution and retrenchment.

Code on Social Security, 2020 (Act No. 36 of 2020)

Consolidates nine social-security laws including EPF/EPS/EDLI, Maternity Benefit, Gratuity, ESIC, Building Workers' Welfare and others. Governs EPF, EPS, gratuity, ESIC and related contributions. See our EPF, EPS & Social Security and Gratuity pages for details.

Occupational Safety, Health and Working Conditions Code, 2020 (Act No. 37 of 2020)

Consolidates 13 laws covering safety, health and working conditions in factories, mines, construction and other establishments. Includes provisions on working hours, rest intervals and overtime for covered establishments.

3. Code on Wages, 2019

The Code on Wages, 2019 is most directly relevant to Precision Payroll calculators because it governs:

  • The definition of “wages” used across labour and social-security law
  • Minimum wage floors by state/UT and scheduled employment category
  • Permissible deductions from wages
  • Overtime wage rate (minimum 2× ordinary rate for overtime hours)
  • Bonus provisions for eligible establishments and employees

4. Wage Definition

The Code on Wages, 2019 defines “wages” as all remuneration expressed in terms of money, including basic pay, DA and retaining allowance, but excluding certain categories such as:

  • Statutory bonus, gratuity, PF/pension contributions, HRA, overtime pay
  • Conveyance/travel allowance
  • House accommodation, light, water and medical allowance up to prescribed limits
  • Other prescribed exclusions

The Code introduces a concept sometimes described as the “50% allowance rule” — the excluded allowances (those listed above) should not collectively exceed 50% of total remuneration, and any excess is deemed wages. This provision has significant implications for PF wage base, gratuity and minimum wage calculations.

ENGINE REVIEW NOTE: The Precision Payroll calculator engines use salary components as entered by the user. The engines do not automatically apply the 50% allowance rule to re-classify components. If your organization's salary structure requires assessment under this rule, consult a qualified HR/legal professional and verify the applicable state rules.

5. Allowances & Components

Under the Code on Wages framework, the classification of salary components as “wages” or “allowances” affects:

  • PF contribution base (Basic + DA is the standard basis)
  • Gratuity calculation wage
  • Minimum wage compliance
  • Bonus calculation base

Precision Payroll calculators use the components you enter directly. You are responsible for correctly classifying your salary structure under applicable rules.

6. Overtime

The Code on Wages, 2019 provides that where an employee is required to work beyond normal working hours, wages shall be paid at not less than twice the ordinary rate for overtime hours (subject to applicable state rules and establishment-specific provisions).

The Occupational Safety, Health and Working Conditions Code, 2020 contains provisions on maximum working hours per day and per week for covered establishments.

The Precision Payroll Overtime Calculator computes estimated overtime pay using a configurable multiplier (default 2.0×). The actual applicable rate depends on the employee's terms of employment, establishment type and applicable state rules.

7. Social Security Implications

The wage definition in the Code on Wages feeds into social-security contribution bases under the Code on Social Security, 2020. Changes in how “wages” are defined or how allowances are classified can affect:

  • EPF contribution base
  • EPS pension base
  • Gratuity calculation
  • ESIC applicability

See our EPF, EPS & Social Security and Gratuity pages for further detail.

8. State Rules & Notifications

Many provisions of the four Labour Codes require state governments to make rules, notifications and schedules. The practical application of the Codes depends significantly on:

  • State minimum wage notifications (vary by state, scheduled employment and skill category)
  • State-specific Professional Tax slabs (not part of the four Labour Codes)
  • State overtime and working-hours rules for specific establishment types
  • State public holiday notifications affecting working days calculations

Always verify the applicable state notifications for your establishment location and employment category.

9. Calculator Notes

The Precision Payroll calculators reflect a simplified model appropriate for estimation and planning. They do not:

  • Automatically apply minimum wage floors for your establishment category
  • Check minimum wage compliance against your state's current notifications
  • Apply the 50% allowance rule to reclassify salary components
  • Handle bonus calculations under the Code on Wages
  • Account for all industry/establishment-specific exemptions

For compliance purposes, verify calculations against the applicable central and state rules under the four Labour Codes.
